Terms Of Service
General

No information of any customer or user of our services will be resold, duplicated, illegally distributed or provided to any external service or individual.

Customers of Stelivo must absorb, reconcile, pay for, or otherwise handle legal or datacenter fees caused by their actions based on using our services.

Billing/Payment

All payments are non refundable. Customers are entitled to a partial refund if services are offline for more than 24 hours and the downtime issue is within the control of Stelivo. Customers will not receive a refund if the issue is the fault of our datacenter or is the result of the customers actions or neglect. It is the user's responsibility to cancel the service, using the correct cancelation feature within the client area. Any user who fails to do this, and pays for unused services, will not be eligble for a refund. Account credit is non refundable under any circumstance. Partial refunds are subject to a 10% service rendering fee.

Returning customers who did not use the correct cancelation feature for the previous services may be presented with a grace fee for the unreliability of the past business between the customer and Stelivo.

Stelivo reserves the right to terminate any service without refund or warning for breach of terms outlined on this page.

Services will be shut off one day after the due date of payment if Stelivo has not received funds. After three days of nonpayment, a 10% late fee will be added (late fee's may vary depending on the service provided). If the customer is aware before hand the funds cannot be delivered on the due date, the customer is entitled to request more time without late fee. If the customer requests more time ON THE DAY of due payment, the customer will still be subject to a late fee.

If paying with an eCheque or other similar payment, Stelivo will not activate services until payment is confirmed.

Support Guidelines

Support is strictly kept to the support ticketing system. Customers seeking support are not to enter any of Stelivo's services (i.e. chat rooms) or email us directly for support. Doing so will act as a waiver of the SLA.

The account area has a feature in which customers can add on additional contacts to their accounts, change settings, and create support tickets. Stelivo will only perform the aforementioned changes on accounts that have active services, and are in good standing.

IRC Products

Certain person(s) have been connecting to Stelivo servers pretending to be employees of Stelivo and gaining administration access. On the rare occasion an employee connects to a customers server the employee's hostname will be *.stelivo.com or 83.142.48.*, If they do not have this hostname, and they are requesting administrative access, report them immediately.

Stelivo.com is not responsible for the content of leased chat servers. The contact information for each servers owner can be found on the chat server. Stelivo has a content regulation policy and will review the websites or nature of each chat it hosts.

The Stelivo team routinely check all IRC servers hosted by Stelivo to ensure no illegal activity is taking place. The staff members hostname will contain *.stelivo.com or 83.142.48.*. If you have specific methods of blocking IRC clients on your chat server we advise you to allow connections from the host *.stelivo.com and 83.142.48.*. If the staff member cannot connect to a customers server, it will be restarted so that the staff member can connect.

Stelivo staff members reserve the right to stay connected to any chat server for any amount of time without providing a reason to the owner. Any attempts to block the staff member in any way, from any access whatsoever, will be deemed as suspicious and may result in termination of the server without refund.

If a customer is using a Stelivo chat server for hosting or participating in any way with Botnets and IRC Trojans, the customers chat server will be canceled immediately. The owner will be reported to the authorities, as well as logs and IP addresses. The customer is not eligible for a refund and will be banned from all Stelivo services in the future.

It is the chat owner's responsibility to ensure the safety of their chat server. Poor judgement and mistakes on the part of an Administrator can result in users taking over a server. If for any reason a server is taken over, there is a $10 reinstatement fee.

If a customer mass floods the Stelivo databases by performing mass K-Lines, mass administration activities, or mass registration of rooms/users, there is a $20 reactivation fee.

Attacks on customer's servers are not the responsibility of Stelivo. Stelivo makes no guarantees about the safety of a cutsomer server. If a customer's server is under persistent attack, that customer is eligible for (1) free IP address change. If another IP address change is required after the free change is used, it is a cost of $10. (This applies to all subsequent IP changes). Please note: Frequent and/or disruptive attacks on customer servers can warrant termination with no refund.

Shared Webhosting

Customers may not host any content that is illegal, an infraction of copyright law, viruses/trojans/etc., child pornography, and any other content Stelivo deems inappropriate. Failure to follow this rule may result in termination of account without notice or refund.

Stelivo webhosting services are for hosting live and active websites. Webhosting services are not to be used as file storage facilities. Failure to follow this rule may result in termination of account without notice or refund.

It is your responsibility to ensure that scripts/programs installed under your account are secure and permissions of directories are set properly, regardless of installation method. When at all possible, set permissions on most directories to 755 or as restrictive as possible. Users are ultimately responsible for all actions taken under their account. This includes the compromise of credentials such as user name and password. It is required that you use a secure password. If a weak password is used, your account may be suspended until you agree to use a more secure password. Audits may be done to prevent weak passwords from being used. If an audit is performed, and your password is found to be weak, we will notify you and allow time for you to change/update your password. Failure to adhere to this rule may result in termination of account without notice or refund.

Stelivo Server Room Hosting

All purchased user rooms are subject to the age group of 16+.

The chat room owner is directly responsible for the chat room, including but not limited to it's content, nature and usage. The chat room must comply with the rules and regulations of the Stelivo chat server. This includes the nature of the chat room and the website connecting to it. The website that links to the chat room must advertise a service that complies with the Stelivo rules and regulations.

All user chat rooms on the Stelivo server belong to Stelivo. The purchaser has full control over the chat room on a leased agreement. Stelivo staff members have rights within the room to edit settings and perform commands to comply with terms of service, with COPPA regulations, in accordance with data center needs, and for the safety/well being of the Stelivo users.

Customers may not display any weblinks on their Chat Room Topic or Chat Room Welcome. Excessive spammed links within the customer's chat room is also not allowed, this could result in the chat room contract being terminated.

If a customer's chat room gets taken over by a person banning everyone, they can type /RESET ROOMNAME. This will clear the ban list and topic which will allow the customer to re-join their chat room. If a customer has made someone an owner in their chat room and that person removes the customer's ownership, there is a $5 reinstatement fee.

The chat room settings are free for the room owner to do as he/she pleases with it. If a customer is on the standard package they are not allowed to enter a colour topic. If standard package customers excessively add a colour topic to their chat room, said chat room will be terminated.

Customers may not enter the chat servers #Help or #Support chat room for assistance regarding your chat room. Use the ticket system inside the client area only. VPS/Dedicated

Hosting IRC product of any kinds on our VPS or Dedicated servers is strictly prohibited. Any affiliation with Botnets, Rats or any others malicious products will ensure the services is terminated without refund.

Mass Mailings - Users may not send mass unsolicited e-mail, which is email that is sent to recipients who have not Confirmed Opt-In or Closed-Loop Opt-In in to mailings from the User. Users who send mass mailings must maintain complete and accurate records of all consents and opt-ins and provide such records to The Planet upon its request. If a User cannot provide positive and verifiable proof of such consents and opt-ins, The Planet will consider the mass mailing to be unsolicited.

Mailing Lists - Users are prohibited from operating mailing lists, listservs, or mailing services that do not target an audience that has voluntarily signed up for e-mail information using a Confirmed Opt-In or Closed-Loop Opt-In process or that has made their e-mail addresses available to a User for distribution of information. Users who operate mailing lists must maintain complete and accurate records of all consents and Confirmed Opt-In or Closed-Loop Opt-In elections and provide such records to The Planet upon its request. If a User cannot provide positive and verifiable proof of such consents and Confirmed Opt-In or Closed-Loop Opt-In elections, The Planet will consider the list mailing to be unsolicited. Any User-maintained mailing list must also allow any party on the list to remove itself automatically and permanently.
